NodBuddy, Inc., a Delaware corporation (“NodBuddy,” “we,” “us,” or “our”), operates the NodBuddy mobile application and associated services (collectively, the “Service”). This Privacy Policy describes our practices regarding information collected through the Service and is incorporated into and governed by our Terms of Service, which include important provisions on limitations of liability, indemnification, dispute resolution, and governing law. By accessing or using the Service, you agree to this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Service.
1. Definitions
“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.
“Sensitive Personal Information” includes precise geolocation, potential health-related inferences from usage patterns, contact details of third parties, and similar data.

We collect only the minimum information necessary to provide the Service reliably and securely, adhering to data minimization principles.
(a) Information You Provide Directly
• Account registration data (e.g., name, email address, phone number—only if provided).
• Emergency/trusted contact information you voluntarily submit (names and phone numbers of third parties).
• Check-in preferences and schedules.
• Photos you optionally upload to your profile (e.g., profile picture).
(b) Information Collected Automatically
• Device and technical data: device identifiers, IP address, operating system, browser type (if web access), and crash logs.
• Usage data: timestamps of check-ins, missed check-ins, app interactions, and analytics events.
• Location data: precise or approximate geolocation (only if you explicitly enable location-based features and grant permission).
(c) Information from Third Parties
Data from telecommunications providers necessary for SMS/email/push alert delivery (e.g., delivery status).
(d) Sensitive Personal Information
We collect Sensitive Personal Information only when strictly necessary for core alert functionality, always with your explicit permission where required (e.g., location opt-in), and only for the duration necessary.
(e) Your Representations, Warranties, and Indemnification Regarding Third-Party Information
By providing information about third parties (such as emergency or trusted contacts), you represent and warrant that you have obtained all necessary permissions or consents from those individuals for us to collect, use, and disclose their information as described in this Policy (including contacting them in the event an alert is triggered). You agree to indemnify, defend, and hold harmless
NodBuddy, its officers, directors, employees, and affiliates from and against any claims, losses, or liabilities arising from your breach of this representation and warranty or your provision of third-party information without proper authorization.
3. How We Use Information
We use information for legitimate purposes related to the Service, including:
• Providing, maintaining, and improving the Service (e.g., sending reminders and alerts).
• Communicating with you (support, updates, security notices).
• Internal analytics, research, product development, and business purposes (using anonymized, de-identified, or aggregated data wherever possible).
• Detecting, preventing, and addressing fraud, security incidents, or technical issues.
• Complying with legal obligations and enforcing our rights.
We may also create and use de-identified, aggregated, or anonymized data for any lawful purpose, as such data is no longer Personal Information. We do not use your Personal Information for marketing or advertising purposes unrelated to the Service.
4. Disclosure of Information
We disclose Personal Information only in limited circumstances:
• To trusted service providers acting on our behalf (e.g., cloud hosting, SMS carriers, analytics tools), bound by contractual obligations to protect the data and use it solely for providing services to us.
• To your designated emergency/trusted contacts when an alert is triggered (e.g., including your optional profile photo only if you have enabled this feature).
• In connection with a corporate transaction (e.g., merger, acquisition, bankruptcy).
• As required or permitted by law, to comply with legal process, enforce our rights, or protect user, public, or our safety.
We do not sell, rent, or disclose Personal Information for marketing, advertising, or cross-contextual behavioral advertising purposes.
We have not sold or shared Personal Information for such purposes in the past 12 months. We may disclose de-identified, aggregated, or anonymized data without restriction.
5. Data Security
We implement reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
6. Data Retention
We retain Personal Information only as long as necessary for the purposes in this Policy, to provide the Service, and to meet legal obligations. Upon account deletion or request, we will delete or anonymize your data, subject to legal retention requirements (e.g., backups, dispute resolution, or compliance).
7. Your Privacy Rights and Choices
Depending on your jurisdiction and as permitted by applicable law, you may have rights to access, correct, delete, opt out of certain processing, limit sensitive data use, or port your data. U.S. and EEA/UK residents have expanded rights under relevant laws. We provide in-app tools (including a “Do Not Sell or Share My Personal Information” option) to facilitate requests. All requests are
subject to verification, legal exceptions, and applicable requirements. We will not discriminate against you for exercising rights.

8. Third-Party Links and Services
The Service may contain links to or integrations with third-party services. We are not responsible for their practices.
9. Children’s Privacy
The Service is not intended for individuals under 18. We do not knowingly collect Personal Information from anyone under 18 and will promptly delete any such data if discovered.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the new policy with a new effective date and, where appropriate, by sending an in-app notification or email. Your continued use of the Service after any changes constitutes your acceptance of the revised Privacy Policy.
11. SMS Communications
NodBuddy may use SMS/text messages to communicate with users who have explicitly opted in to receive SMS communications from NodBuddy.
SMS messages may include:
- Check-in reminders
- Missed check-in notifications
- Account and service notifications
- Notifications related to your Buddy connections
- Customer support communications
- Other service-related messages that you have consented to receive
Message frequency varies depending on your use of the NodBuddy service and the notifications associated with your account.
Message and data rates may apply. Charges may be imposed by your mobile carrier according to your mobile plan.
SMS Consent
By selecting the SMS consent checkbox during registration, you expressly agree to receive SMS messages from NodBuddy at the mobile number you provide.
SMS consent is not required to accept the general Terms of Service or to use features that do not require SMS communication.
You may withdraw your SMS consent at any time by replying STOP to an SMS message from NodBuddy. After receiving a STOP request, NodBuddy will stop sending SMS messages to that number, except where necessary for service-related or legally required communications.
